From the reports, it looks like the White House and DOJ lawyers advised against destruction, but the CIA decided in favor on its own. In other words, the Dems are going after their allies in a case that is guaranteed not to touch the White House, since the destruction was done without the WH's knowledge or consent. Now, of course, I think the CIA had every right to destroy the tapes if they wanted. BUT, if the dems are going to make a big deal out of this, they're targeting the wrong the people who are alreay on their side! Reminds me of Al Qaeda - destroy your friends out of frustration without laying a glove on your enemies.
